Subclass 115 and 835 Visas 

If your only near relatives live in Australia and are an Australian Citizen, Permanent Resident or eligible NZ citizen, they may be able to sponsor you to live, work and study in Australia permanently on a Remaining Relative visa, namely:

  • Onshore (subclass 835): you must be in Australia when the application is lodged and when it is decided; or
  • Offshore (subclass 115): you must be outside Australia when the application is lodged and when it is decided.

 

Am I eligible to apply for the 835 Visa?

What are the Remaining Relative (Subclass 835 & 115) Visa requirements? You may be eligible if you

  • have an eligible family member who is a settled Australian citizen, permanent resident, or eligible New Zealand citizen that sponsor you
  • do not have any other near relative who lives outside Australia
  • have the assurance of support
  • you do not have any previous visa cancellations and have complied with conditions of your previous visa.
  • you meet health and character requirements.

Visa requirements:

To be able to sponsor you for a Remaining Relative visa, your sponsor must be:

  1. Your parent, brother, sister, stepbrother, stepsister or one of their partners;
  2. 18 years or older;
  3. Settled in Australia;
  4. Able to provide you with accommodation, support and financial assistance for the first 2 years of your residency in Australia.
  5. Eligible to sponsor you, not successfully sponsored someone previously on a Remaining Relative visa,

To be eligible for the visa, you must meet also meet certain health and character requirements.

The Department of Home Affairs visa cost of a Remaining Relative Visa is AUD $6,415. You may pay this visa in 2 instalments. The costs of health checks and police certificates are excluded.

 

Processing Time

The Department of Home Affairs grants a limited number of the 835 and 115 Visa in each Migration Program year. That means when the limit is reached, no more visa is granted. Because of that reason, processing times are not available for this visa. Completing the application with the necessary documents, responding to any requests quickly and providing required information can help expedite the process.

Your near relative can be your parent or your partner’s (biological or step) parent, brother/stepbrother, sister/stepsister.
